In this day in age of camera phones and the quality they give, hiring a professional takes the guess work out of the capture. We take the ease of stress from guessing the shot to knowing the shot. We take quality and placement and detail down to the art and capture the moment in a time capsule with and at dynamics most new day phones cannot fathom in depths of reaching. Hiring a professional also allows you to get the most out of your activity and enjoy your moments more.
A deposit with each booking to provide a little security and peace of mind. This holds people accountable and shows them the value of your time.
A cancelation with less than 48 hours’ notice causes us to lose valuable time that we could be handling other sessions. It doesn’t give us enough time to re-book or find another client.
People are impatient and they want their finished product as soon as possible. They often don’t understand the time-consuming process of editing and proofing photos before they can be delivered to the client.
On average, we look towards a 5-7 week period to produce a final finish completed total project. The reason forward for this case is quality. We want to make sure we double check and make sure your final completions are above the level of perfection. The process is usually strenuous with all sorts of interruptions and time constraints. From shooting to organizing to selecting and drafting to editing and proof editing and finally moving to print and completion of the project, we take great care and consideration when progressing each component to a successful close.
Today, people often want digital copies of photos along with or even instead of physical photos. Moreover, some photographers only work with certain mediums in the same regard, for one reason or another. Therefore, most people will ask if digital images are available if they want them.
A digital receipt of raw captures will be sent to the client prior to any drafting/editing phase. This way the client can choose what images they want to have edited and touched up. This is no cost, however, the digital link will only be available for a total of 10 consecutive days after sending out of link. The client will receive a proof draft of the images after editing and then receive the final digital link (if paid) a long with any other finish and paid components.

Any client who does not cancel or reschedule within 48 hours of session will forfeit the $50 retainer and it will serve as a cancellation fee. As previously stated, the fee can be credited towards a future session if the client reschedules the appointment by calling 48 hours prior to the date of session and re-booking at an agreeable date and time.
If JP Dezigns Photography cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return the retainer fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event JP Dezigns Photography fails to perform for any other reason, JP Dezigns Photography shall not be liable for any amount in excess of all monies paid.
Most sessions depend on the client. We normally look at a 2 hour time frame depending on the client location picks, clothing change, props, etc. the lowest time would be 15-20 min mini shoots however events such as weddings and such may last 3 hours more or less. Commonly a normal photo shoot can take 1 hr with everything in place and ready to go.
In this raging world of the internet, smartphones, and social media, one thing we are very used to is sharing our images and happy memories on various social platforms. This opens doors wide open for anyone who wants to take your photographs and use them for their own purposes. Of course, nobody wants their personal content to be used without their consent or even knowledge but anything that enters the internet space is prone to theft and your images are no exception.
It’s even worse if you’re an artist, designer, or photographer as your financial well-being may depend on your images. Unfortunately, image theft is the most common problem you’ll encounter on a regular basis. It’s been a problem since the inception of the internet and there is little we can do to stop this. Here are some image protection techniques we follow that make it more difficult for thieves to steal them.

JP Dezigns Photography (The Photographer) shall own the copyright on all images created and shall have the exclusive right to make reproductions and edits of any kind. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, website, or for display within or on the outside of the Photographer’s studio.
The Client is obtaining photography services for personal use only, and shall not sell said prints. If Client is obtaining a print for newspaper announcement of the wedding, editorial use or website, Photographer authorizes Client to reproduce the print in this manner. In such event, Client shall run a credit for the Photographer adjacent to the photograph. If Client is obtaining photography services for commercial use, Client shall give photographer credit where applicable, and agree to post advertisements and/or business cards on behalf of The Photographer at their place of business.
Client is never permitted to edit or alter any photo that is copyright of JP Dezigns Photography.
The entire copyright, title, and intellectual property rights of any Images will remain that of The Photographer at all times throughout the world.
Photographer Travel Fee
You'll need to pay an additional photographer travel fee of around 50 to 100 percent of their regular hourly rate if they're coming from outside of their local metropolitan area.
Photography Sitting Fee
A photography sitting fee, also known as a booking fee or session fee, is an upfront cost to cover the photographer's expenses for setting up a photoshoot. It can cover the costs of booking the venue, private consultation services, and the time spent preparing their equipment.
With some freelance photographers, the sitting fee may also include a partial payment for the minimum amount of photos the photographer will produce for their client.
Sitting fees are essential to photographers so that they don't lose money or the opportunity to do another photoshoot when a client suddenly cancels or doesn't show up for their appointment.
Federal law states that the photographer owns the original copyrights to all of their photos as soon as they take them, especially for commercial purposes. Most buyers would only buy the copyrights to images when they want to resell the photo exclusively, if the image includes their proprietary personal brand symbols or trademarks, or if they have personal reasons why they don't want the images licensed to anyone else.
If you do not specify that you want to buy the copyrights to your images, then a photographer is free to license them to other companies for marketing purposes and feature them in their portfolio.
A copyright purchase always comes at an additional charge to the price of hiring the photographer for the original photo shoot. Keep in mind that a photographer must grant copyright privileges in writing because copyrights don't automatically transfer to the buyer with their purchase.
The selection of proper clothing for your portrait is a critical factor in the preparation for a successful portrait. If the clothing is noticeable or overbearing in a portrait, it could easily become a distraction. Clothing that does not attract attention to itself is the ultimate goal. It could be the difference between a very successful portrait and just another picture. You may be asked to change your clothing selection before I take your portraits if you do not follow these basic guidelines.
Dark clothing tends to slenderise. Darker clothing helps to blend the bodies with the background, so that the faces are the most important part of the photograph. Dark colors definitely tend to slenderise the subject.
Tone down bright colours. Bright colors attract attention away from the face and may be reflective. Avoid wearing red, bright pink, bright green etc. When choosing lighter colors, stick to pastels, but avoid pink tones. Pale yellow and pale blue work well, especially with jeans or kaki pants. These colours work great in nature for example, if you have a sunset photography session booked in.
Light clothing can look beautifully fresh. If you are worried about not appearing slender then it is safer to avoid white. White can look beautifully simple and fresh. White shirts and/or blouses under a dark jacket are perfect.
Prints and patterns are a definite NO. This includes logos. Avoid prints of any kind and patterns. No matter how small the print or the pattern, it will become a distraction. In the case of digital portraits, in particular, small patterns in clothing (even a small herring-bone or checkered pattern) can cause terrible distortions to appear in the portrait that are not originally there.
Avoid short sleeve clothing and short pants. Long sleeved clothing is a MUST! For casual portraits it is equally important to wear long pants instead of shorts. When arms and legs are exposed to the camera there will be more flesh in the photograph in those areas than on the face, itself. This is a major distraction.
Don’t over accessorise! Overbearing or heavily noticeable accessories can be a major distraction. Simple and minimal works best.
Glasses. Eye glasses may or may not be worn. Non-reflective lenses, of course, are a big help. Better yet, sometimes it’s possible to obtain a matching set of frames without any lenses. This is particularly helpful, if your lenses sometimes distort the outline of your face.
Make Up, Hair & Nails. Hair styles should be SIMPLE and MUST be off the face. Hair falling down onto the sides of the face create distracting shadows. Bangs that come down too low onto the face will keep light from getting into the subject’s eyes – the very most important part of the face. It is always a great idea to have your make up and hair professionally applied for your photography session. It will make a huge difference in how you look and feel. If you have your preferred hair and make up stylist this is always ok or we can assist in booking hair and makeup with our Hair & Makeup team. As look as you feel and look fabulous and you allow enough time to have your hair and make up finished before your scheduled session. Your nails should be manicured. No chipped nail polish.
Group / Family Portrait Sessions. Keep your clothing simple and coordinating. It must be carefully selected to blend the bodies together. Avoid loud or busy patterns and large logos. Solid colors are best. First, decide whether the basic tone of the clothing will be warm-toned (browns, etc.) or cool-toned (blues/grays/blacks, etc.) Then, make sure to follow all of the above instructions. Keeping a group in similar colors focuses the attention of the portrait to the faces and individuals that make up the portrait. Dissimilar colours in groups tend to be more distracting.
White tops with khakis or jeans can look very nice and casual, but if anyone in your family is super pale, white can make pale skin look paler. Jeans are the timeless choice and they’re great for fun, casual pictures because they are flattering and don’t show wrinkles or panty lines. Lighter shirts on top give the pictures a more casual and bright look. Pastels are also usually appealing because they enhance natural skin tones. Black or other dark shirts on top give the portraits a more serious and thoughtful feel (not to mention that black is slimming). Everyone should have color-coordinated outfits (Not a uniform necessarily, but there should be a theme). For the children, choose outfits that fit well without a lot of “growing room”. Jeans / khaki’s and white or black tops are always very nice for a family portrait.
Tip. Lay out all the clothing onto a bed. Shoes, socks, stockings – everything should be included…shoes, too! Then, take a careful look at the collection. If your eye goes to any one item in particular, you can be certain that the same thing will happen in a photograph. That item should be changed. Clothing should not be too tight or too loose.
Maternity. The goal is to show off that adorable baby bump, I prefer to do maternity on a solid black or white backdrop. Black, from head to toe is usually good (a flowing white outfit can also look great). A simple black or white (or both!) button down top in which the bottom area can be unbuttoned easily to expose your belly works best. Please encourage the father (and your children if you have others) to come along if you wish (they should also dress in solid black or white). Several poses with your hands showing will be taken, so be sure to remove any jewelry that you do not want in the pictures (some women want to have their wedding ring in the picture, others do not. Most prefer to remove their wrist watch).
If you know you are having a boy or a girl and/or know what your baby will be named please let me know that info as well. Finally, be assured that I will not ask you to leave your comfort zone. I don’t want to ask you to do anything that you are uncomfortable with. Please be up-front in regards to what you would like, and are willing to do. I promise that we will do very graceful and tasteful posing for your pictures.
Newborns and Babies. 95% of the time, photographs of newborns and babies look best in their natural element i.e…their birthday suits! If you want them to be photographed with clothes, solid colors usually work best. Of course if you have that amazing outfit that you would love a photograph of, include it. Bare feet are a must. Feel free to bring any kind of prop that you want included. I prefer parents to dress in solid black from head to toe so that I can get the creative shots you are looking for. TIP: Bring along your babies favourite squeeze toy or anything that you know will get your babies attention during the session.
Your portraits are meant to be enjoyed for generations to come. Fad-type clothing should be avoided, unless you are planning to have new portraits made annually. You will feel very rewarded when you view your photographs. All of your efforts will be worthwhile.
If Photographer is unable to supply his photographic services due to illness, mechanical breakdown, accident, acts of God, or any other cause beyond his control, then Photographer will attempt to procure the services of another professional photographer to fulfill his obligations. If that does not succeed, Photographer will return any fees paid by Client and will have no further liability with respect to this Agreement, and Photographer will not be responsible or liable for any other damages beyond the amount of this Agreement.
This limitation of liability will also apply in the event that any Image is lost or damaged through equipment malfunction, or otherwise, without the fault of Photographer.
Once images are paid in full, you will receive a link to your created folder where you can download each image as well as video. Select images from your session will be featured in our online gallery portfolio whereas, each photo will have a business logo watermark over the photo to protect it from theft and from having anything manipulated from it. Downloads of the images will be soon available through our web site also.
Once the proofs have been shared and returned as selected images for purchase, please allow 2-3 weeks to have a finished product ready to present to the client for purchasing phase. Altogether, from the end of the shooting session, on average, we should see 4-6 weeks to get the viewing the proof and selecting what images you would like to purchase and edited/touched up and have them returned back. Also, depending on the size of your project may be the time difference in receiving (ex. bigger projects and take a little longer, as smaller projects may not take as long.

We accept credit cards through PayPal or through using our Square payment method. Overall, we do accept CashApp, Venmo, Zelle, and Money Orders. Checks are the forms that we don't accept at the moment.
Photography services are set with either hourly rates, daily, in packages, or per photo. Hourly rates are typically between $50 to $200, while day rates range from $300 to $3,000 per photographer. Photoshoot sessions and packages start at $100 and quickly go up to $500 or more.

Photographer Hourly Rate
Although a photographer may charge $100 to $250 hourly, once they factor in their travel fees, equipment, supplies, insurance, and editing time, they may only make $50 per hour.
Freelance photographers can charge up to 20 percent more if they have Adobe After Effects or Photoshop skills and graphic design experience. Remember that the photographer charge per hour changes a lot based on their location, also due to the cost of living.
Photographer Day Rate
A photographers day rate fluctuates between $300 and $3,000 depending on how many hours worked, the amount of setup work, and how many key shots the client requests. A small birthday party is $150 an hour for the first two hours and $100 hourly after that, while a wedding averages $2,000.
If it's a large gathering with more than about 50 guests, then you'll likely need more than one photographer which can double your costs. They may have to bring in additional photography lighting if the party is at night, which will cost more as well.
An experienced photographer knows it takes a lot of time to select, edit, and process a set amount of photos from one day of shooting. You need to set your target goal for the number of shots you want or the fixed amount of hours for taking those photos.
Typically they will also include in their contract an option for you to see all the photos that they've taken, or their best selection of all the pictures from that day, if you want to order additional prints.
Photographers charge between $25 and $500 per hour with most spending $94 to $262 per hour on average. Prices largely depend on their skill level and what type of event they are shooting. Extra costs include travel time, prints, digital image files, and photo editing fees.

Hobbyists: less than $50 per hour / $10 to $25 per image. These folks are avid photographers who do it for fun on the side without having studied professional techniques and best practices.
Amateur: $25 to $100 per hour / $25 to $50 per image. Amateur photographers have built up an online portfolio and have sold their images to other clients. Still, they haven't had any professional photography education, but offer much lower prices.
Student: $50 to $100 per hour / $25 to $100 per image. They may have an apprenticeship where they work directly with a professional photographer, or they may also take photography and related media classes in college.
Semi-Pro: $75 to $150 per hour / $50 to $150 per image. These are mostly part-time photographers with a strong education in the field and more than one year of experience.
Professional: $100 to $300 per hour / $75 to $350 per image. These full-time photographers have an extensive portfolio, strong skills, years of education, and several years of experience.
Top Professional: $200 to $500+ per hour / $400 to $1,000+ per image. Exclusive full-time photographers like these are in high demand for top magazine publications, advertising companies, and the film industry.
A typical professional photographer costs between $75 and $300 hourly, or from $75 to $375 per photo because they put significant pre-production and post-production editing work into creating the final print.
Professional pictures prices increase up to $200 to $500 hourly or about $300 to $2,000 per image for top photographers with higher demand. This group of photographers is less than 10 percent of the majority in the industry.

Freelance photography rates may be as low as $25 per image, or as high as $150 per photo depending on their level of expertise. For more images than initially planned in your photo shoot, photographers may offer a 25 percent discount.
Freelance photographers charge according to their expenses to maintain all of the equipment they have, as well as the amount of time they invest in editing professional photos. They are independent contractors who often rely on seasonal work, whereas company photographers sometimes charge less since they don't pay for their own equipment and insurance.
Beginner, hobbyist, and amateur photographers typically charge $25 to $100 per hour depending on where they are located. Photographers who are still developing their online reputation and Photoshop skills make around $25 hourly in the Wisconsin area, but they can make $80 hourly in New York.
A photography price list for beginners is harder to create because they don't have enough experience yet, especially when working as a freelancer. Most use a cost-plus-profit model as a starting point, then start to charge premium prices as they become established.
When booking a session, you agree to these terms of service upon paying your booking retainer fee. Any trade work agreed to by the photographer and another vendor is still subject to these terms and conditions.
This Agreement is between JP Dezigns Photography (“Photographer”) and [You] (“Client”) which includes Client’s principals, employees, affiliates and representatives. Client agrees that it has the legal authority to enter into this Agreement on behalf of its employer, company or organization. Photographer’s relationship with Client is that of an independent contractor.
“Image(s)” means the photographic material, whether still or moving, created by Photographer pursuant to this Agreement and includes, but is not limited to, transparencies, negatives, prints, or digital files, that were captured, recorded, stored, or delivered, in any type of analogue, photographic, optical, electronic, magnetic, digital, or any other, media.
Definitions
The Photographer: JP Dezigns Photography
The Client: Any person, body of persons, firm, or Company with whom the Photographer enters into a contract for the sale of goods or provision of services by the Photographer.
Proof: Samples of all edited photos, in which JP Dezigns Photography (The Photographer) holds all exclusive rights to. These cannot be saved to Client’s computer, used on social networking sites, or printed, and will contain either JP Dezigns Photography’s logo, watermark, or proof stamp. All full sessions include 50 proofs, and assigned mini-sessions include 15 proofs.
Sitting Fee: Price including all “non-tangible” portions of the photography session. This includes, but is not limited to The Photographer’s TIME: time spent PREPARING for shoot, time spent DURING the shoot, and time spent EDITING the shoot. Preparing: Includes but is not limited to time e-mailing, setting up studio (bringing out necessary props, reconfiguring lighting for shoot, sanitizing props that may be used with newborns and children, and so on). During Shoot: Session fee for newborns always includes a block of 3 hours for the shoot. Standard Sessions in studio up to 2 hours, Standard Sessions on-location includes travel time. Post-Production: Each photo takes approximated 20-30 minutes in post processing. Every full session includes 20-50 edited proofs, Mini-Sessions include 10-15. This also includes time spent setting up Client’s online gallery and personalized shop. Also included in the session fee is general expense and wear and tear of props and equipment (including but not limited to memory cards, lighting, light stands, diffusers, light bulbs, beanbag poser, props, camera, lenses, and editing equipment).
Digital Purchases: High-resolution digital copies of the final images. When purchased, Client receives license for Royalty-free for personal use. The owner ("Owner") of the copyrighted photograph or video being purchased (the "Work"), hereby grants you the non-exclusive, non-assignable, non-sublicensable, and perpetual right to use, reproduce and distribute the copyrighted Work for personal non-profit purposes, and to incorporate the copyrighted Work, in whole or in part, into derivative works for non-profit distribution. You are prohibited from using the Work for any other purpose, including: using, reproducing or distributing the Work and/or materials incorporating all or any part of the Work for profit; selling or distributing electronic copies of the Work as standalone files or as part of a product from which a person is able to extract the Work as a standalone file; distributing the Work in or as part of an electronic template (e.g., as an image available in a word processing or web page creation application) intended to be reproduced by third parties on electronic or printed products; or using the Work as part of a trademark, service mark or logo. Owner retains all other rights in the Work and any derivative work, including without limitation, the right to use, copy, sell, license, and distribute copies of the Work in all markets and territories. In consideration for the grant of this non-exclusive license, you agree to pay Owner the amount specified, due and payable immediately prior to your downloading a digital copy of the Work. This Agreement shall be construed and enforced in accordance with the laws designated by Owner, now or in the future.
Sole Photographer During Session
During your photography session with JP Dezigns Photography, the Photographer will be the ONLY person permitted to take photos. Parents, friends, family, and anyone else attending the session is NOT permitted to take any photo with cameras, camera phones, tablets, etc. and must be informed of this rule. If photos are taken with cell phones or personal cameras, those will be the only photos available to you from the session. The session may still continue, but all photos taken by Photographer will not be processed and turned over to client. Photographer will still hold the rights to use photos in portfolio or advertisements.
Facebook Sharing and Other Social Media
It is understandable that the Client might want to post their new photographs on the Internet via Facebook, Twitter, Tumblr, Instagram, and/or any other social media outlets. This agreement will serve to allow posting low-resolution or high-resolution photos to social media sites, only in the case that JP Dezigns Photography is credited and that photos are NOT altered with editing or filters. Additionally, it is understood that the client will NOT remove, or have removed, watermarks from Internet images JP Dezigns Photography has uploaded to Facebook or her website, or from the low-resolution images offered for free to clients who have purchased prints. The Client and family members can purchase photographs that do not have a watermark.
You are permitted to click the “share” button on any photos posted to JP Dezigns Photography’s Facebook page. Sharing can NOT be done via screen shots of photos on Facebook or the Proofing gallery.
Proofs and Ordering
Your portraits will be available on JP Dezigns Photography’s website, in a gallery to view and proof prior to ordering prints. Final edited proofs will be available 4 to 6 six weeks after the date of the session. Proofs will be available for three months and then the gallery will expire. Clients may request a re-opening of their gallery after it has expired. An unarchiving fee of $40 will be incurred. Upon receipt of payment your gallery will be live for 14 days.
Edits
JP Dezigns Photography reserves the right to edit and release only the images that are deemed creditable as professional in quality and within JP Dezigns Photography’s standards. The photographer enhances photos via corrections to contrast, lighting, and color, as well and removal of baby acne, rashes, and accidental last minute scratches, bumps, etc. JP Dezigns Photography does not change any inherent qualities of a person, as it is considered a "cosmetic edit" and will be $20 per photo if it is requested by the client after seeing the edited proofs. Cosmetic edits include, but are not limited to: removing unwanted facial hair, adding hair to balding head, changing hair color, changing shape of nose, eyes, body, etc. It is requested the client take care of all cosmetic changes before the shoot if they do not wish to have gray hair, facial hair, etc. in final photos.
Once again, edits are solely made by JP Dezigns Photography, any edits by clients or family members to digital files will void contract and close gallery from future re-openings.
Copyright and Reproductions
JP Dezigns Photography (The Photographer) shall own the copyright on all images created and shall have the exclusive right to make reproductions and edits of any kind. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, website, or for display within or on the outside of the Photographer’s studio.
Placement of a credit line or copyright notice is required when posting the images on the internet. If a credit line or copyright notice is required but not actually provided, Client agrees that the amount of DOUBLE THE INVOICE TOTAL is the fair and reasonable compensation that will be paid to Photographer for the loss of recognition, or lack of copyright protection, resulting from the lack of, or an improper, copyright notice or credit line.
Deposit and Payment
The Client shall make a deposit to retain the Photographer to perform the services specified herein. At such time as this order is completed, the deposit shall be applied to reduce the total cost and Client shall pay the balance due. Balance shall be paid in full during or before the session for the service to be provided. JP Dezigns Photography accepts cash, CashApp, Venmo, Zelle, and all major credit cards and debit cards through Paypal.
Time is of the essence for receipt of full payment under this Agreement.
NO RIGHTS ARE GRANTED UNTIL PHOTOGRAPHER HAS RECEIVED FULL PAYMENT, INCLUDING, IF APPLICABLE, ANY LATE-PAYMENT CHARGES.
UNLESS OTHERWISE AGREED, THE USE OF ANY IMAGE(S) PRIOR TO FULL PAYMENT WILL BE CONSIDERED AN UNAUTHORIZED USE. CLIENT AGREES THAT THE REASONABLE AND STIPULATED AMOUNT THAT WILL BE PAID TO PHOTOGRAPHER FOR SUCH AN UNAUTHORIZED USE WILL BE DOUBLE THE INVOICE TOTAL.
Where usage rights before full payment are granted, Photographer reserves the right to rescind any such usage rights if Client fails to make timely payment.
All invoices are due upon receipt. Adjustments of amounts or terms must be requested within ten days of invoice receipt.
Photographer does not provide any receipts to Client. Photographer’s invoice will serve as Client’s receipt for work performed and services rendered. Bank transfer fees are the responsibility of the Client.
Client’s Usage
The Client is obtaining photography services for personal use only, and shall not sell said prints. If Client is obtaining a print for newspaper announcement of the wedding, editorial use or website, Photographer authorizes Client to reproduce the print in this manner. In such event, Client shall run a credit for the Photographer adjacent to the photograph. If Client is obtaining photography services for commercial use, Client shall give photographer credit where applicable, and agree to post advertisements and/or business cards on behalf of The Photographer at their place of business.
Client is never permitted to edit or alter any photo that is copyright of JP Dezigns Photography.
Client acknowledges that Photographer is the Author of the Image(s) and also the first and sole owner of all copyrights of the Image(s). The Image(s) and all copyrights remain the exclusive property of Photographer without limitation. All usage rights to the Image(s) specifically granted by Photographer to Client appear on this Agreement.
IMAGES ARE LICENSED FOR SPECIFIC USE(S) AND ARE NOT SOLD.
Client understands and agrees that it is not buying the Image(s) but is paying only for a license to use the Image(s) as specified on this Agreement. Note that buying the copyright to the Image(s) will always be much more expensive than any licensing fee.
The term of license begins from the date Photographer receives full payment of invoice and upon delivery of images.
Unless otherwise agreed, any rights granted are always non-exclusive, non-sub-licensable and non-transferable. Any Image(s) may not be used in a logo, corporate identity, trademark or other service mark.
The use of any Image(s) by Client will not constitute a work of joint authorship.
Copyright metadata contained within any digital file may not be altered, or removed, without the express consent of Photographer.
Unless otherwise agreed, Photographer retains the right to use the Image(s) for his self-promotion.
PHOTOGRAPHIC INTEGRITY AND ALTERATIONS:
Client will not make or permit any alterations, including, but not limited to, filters, additions, subtractions, or adaptations, with respect of the Image(s), alone or with any other material, without the prior express permission of Photographer.
Portrait sessions include editing which consist of changes to the color, crop, contrast, & exposure at the photographers discretion. Portrait sessions do not include retouching. Boudoir sessions include retouching done at the photographer discretion.
GENERAL LIABILITY AND RELEASES:
Photographer will take all reasonable care in the production of the Image(s) and the performance of this agreement. But Photographer will not be liable for any loss, damages, or costs, suffered by Client, or by any third party, arising from Client’s use of any Image(s).
Client will indemnify, defend, and hold harmless, Photographer, his contractors, and his representatives, against any and all claims, liabilities, damages, costs, and expenses, including reasonable legal fees and expenses, that may arise from Client’s use of any Image(s).
Photographer is not responsible for obtaining model, property, trademark, copyright, or any other, releases in connection with the Image(s) unless specifically stated in this Agreement. It is Client’s responsibility to obtain all necessary permissions for any Image use that requires a release or other consents.
Should Photographer agree to deliver any releases, it is Client’s responsibility to determine whether such releases are suitable for Client’s purposes. Photographer gives no warranty or guarantee as to the legal validity of any release.
In any event, Photographer’s liability for all claims will not exceed the total amount paid under this Agreement.
Inherent Qualities
Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes as well as DVD or CD media which may deteriorate due to delamination and oxidation, and Client releases Photographer from any liability for any claims whatsoever based upon the deterioration due to such inherent qualities. Additionally, The Photographer is not responsible for inevitable low-quality resulting from Client printing from any and all non-professional printing labs, including, but not limited to Walmart, Walgreens, Target, CVS, etc. It is to be noted that JP Dezigns Photography suggests printing from professional printing labs such as mpix in order to receive highest quality prints.
Failure to Perform
If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
If Photographer is unable to supply his photographic services due to illness, mechanical breakdown, accident, acts of God, or any other cause beyond his control, then Photographer will attempt to procure the services of another professional photographer to fulfill his obligations. If that does not succeed, Photographer will return any fees paid by Client and will have no further liability with respect to this Agreement, and Photographer will not be responsible or liable for any other damages beyond the amount of this Agreement.
This limitation of liability will also apply in the event that any Image is lost or damaged through equipment malfunction, or otherwise, without the fault of Photographer.
Portrait Care
Handle your portraits with extreme care. Damage incurred as a result of improper handling, framing or hanging is the responsibility of the client.
Safety
JP Dezigns Photography reserves to right to terminate coverage and this contract, and leave the location of the event(s) if the photographer representing JP Dezigns Photography experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the event(s). In such circumstances, the retainer fee and any deposits paid will be non-refundable.
Severability
If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.
Miscellaneous
This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the States of Georgia.
ACCEPTANCE OF TERMS:
Client may not assign or transfer this Agreement or any of the rights granted hereunder. This Agreement is binding upon, and inures to the benefit of, Client and Photographer, as well as their respective principals, employees, representatives, and successors. Client and its principals, and employees, are jointly and severally liable for the performance of all payments and other obligations hereunder.
No amendment or waiver of any items is binding unless set forth in writing and signed by the parties. E-mail and electronic signatures will be considered legal and binding. However, the invoice may reflect, and Client is bound by, Client’s oral authorizations for any additional Image(s), fees, and expenses, that could not be confirmed in writing due to the immediate proximity of completing the photography assignment.
This Agreement will be deemed to be a contract made under the laws of the United States and the State of Georgia, and for all purposes will be interpreted in its entirety in accordance with these laws. Client specifically and irrevocably confers personal jurisdiction over it by the courts of the state of Georgia. Client will pay all arbitration and court costs, reasonable legal fees, expenses, and legal interest, on any award or judgment in favor of Photographer.
If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
In addition to oral and written agreements, placing a retainer fee for a future session and/or use of any Image(s) by Client will constitute acceptance of all the above terms and conditions.
This Agreement constitutes the entire and only agreement between Photographer and Client with respect to its subject matter and supersedes all previous agreements, understandings, and communications, whether oral or written, between the two parties with respect to the subject matter hereof.
There is a vast difference between taking a picture and making a photograph.

In order to secure your shoot, a $50 booking fee is required. This is not an extra fee, but is deducted from the full sitting fee.
Accepted forms of pay: cash, money order, CashApp, PayPal, Venmo, or Zelle.
Once your payment has been received, JP Dezigns Photography will contact you and your session date will be reserved. Your spot will not be held until this is completed.
Booking and Rescheduling
The $50 booking deposit, required of all sessions, is nonrefundable, with the exception of rain dates for outdoor sessions. Clients are permitted one rescheduled session if rescheduling request is made at least 48 hours before the session. After one permitted rescheduling, any further rescheduling will require an additional booking fee of $50 to hold your spot.
CANCELLATIONS AND POSTPONEMENTS:
A 50% retainer fee is due to hold your session date. This fee is non-refundable. The remaining balance is due the date of your session. If you cancel your retainer is forfeited and may not be applied to another session. If you do not cancel and the photographer arrives at the location of the session you will be responsible for paying the remaining 50% balance.
RESHOOTS:
If Client requires a reshoot, Client will pay Photographer an additional fee of one hundred percent of the fee stated in the quote or invoice for the original shoot, plus all expenses for the reshoot.
If a reshoot is required due to factors beyond the control of Photographer, including but not limited to, weather conditions, or acts of God, Photographer will not charge an additional fee and Client agrees to pay all expenses for the reshoot.
KILL FEE:
Provided that Photographer has executed the photography assignment in a professional and competent manner, Client agrees to pay Photographer all fees and expenses in connection with said assignment, whether or not Client uses any Image(s).
ARCHIVING DIGITAL FILES:
While Photographer may choose to archive the Image(s), it is Client’s responsibility to properly store and archive the Image(s) for the duration of the term of license. Photographer cannot guarantee the availability of any Image(s) beyond the date of first delivery to Client.
Client is aware that optical, magnetic, electronic, and any other, media for storing digital data are inherently unstable. Client hereby releases Photographer and his contractors, and representatives, from any liability for any claims, damages, or costs, arising from any media supplied by Photographer becoming unusable.
All digital files created by, or on behalf of, Client that contain any Image(s) will be deleted or destroyed within ten days after the expiration date of license.
Any requests for the photographer to reproduce images that were already delivered will incur a $80 processing fee.
DIGITAL FILE QUALITY:
Photographer is committed to providing high quality services. Unless otherwise specified, Photographer may deliver, and Client agrees to accept, the Image(s) encoded in an industry-standard data format that Photographer may select, at a resolution that Photographer determines will be suitable to the reproduction technology and use(s) for which the Image(s) is licensed.
Photographer uses cameras and monitors that are color calibrated to industry standards. But due to variances in other monitors, software and computer platforms, the Image(s) may display differently on other monitors. Therefore, neutrals will be set for mathematical neutrality and color will be adjusted for pleasing tonalities.
It is Client’s responsibility to verify that the digital data, including color profile, if provided, are suitable for reproduction of the expected quality and color accuracy, and that all necessary steps are taken to ensure correct reproduction. If the data are not deemed suitable, Photographer’s sole obligation will be to replace or repair the data, but in no event will Photographer be liable for poor reproduction quality, delays, losses, expenses, or consequential damages, resulting directly, or indirectly, from defects or errors in digital files or their use.
All editing is done at the photographer’s discretion. The photographer reserves the right to refuse any additional edits requested. Some images may only be produced in color or black and white at the artists discretion. If the client(s) wish to request additional editing of images this is done at a separate fee starting at $25 per image.
SESSION TERMS:
Sessions will be conducted at a location agreed upon by the photographer. The photographer will not trespass or use any property/locations that is considered unlawful to do so. The photographer is bound by any rules states for the property or location. If the Client wishes to shoot on private property it is the Clients soul responsibility to get authorization from the owner of the property. The photographer is not responsible for hazards at the location and the Client agrees to enter into the session at their own risk.
No other photographers/videographers are allowed during the session unless agreed to in writing by JP Dezigns Photography. Client or guest will refrain from taking cell phone images during the session unless agreed upon by the photographer.
